JunHe is very proud of its strong team of lawyers who have ample experience and solid expertise in the field of labor and employment law practice.  The JunHe L&E team has seven partners and about 20 lawyers.  They are strategically stationed in Beijing, Shanghai, Guangzhou and Shenzhen, and provide renowned domestic and foreign clients with precise, practical and efficient labor law services on a daily basis. 

 

The JunHe L&E team specializes in assisting clients in negotiation, arbitration/litigation, dealing with complicated and emergent incidents or crisis and  collective bargaining with trade unions or employee representatives.  Meanwhile, the JunHe L&E team play a key role in the areas of legislation and legal practice. 

 

The JunHe L&E team has received a high degree of recognition and respect within the legal community due to its long-time commitment and passion for labor law practice.  The JunHe L&E team has been recognized as a Band 1 Labor & Employment Law Practice Team of China by Chambers & Partners each year since 2009, which is the very first year they started to issue such a ranking.

 

Core Areas of Practice

 

  • Representation in all kinds of labor dispute resolutions in major cities throughout China for clients (including complex cases and collective cases), including but not limited to representing clients to attend the labor dispute mediation, arbitration and litigation;

  • Drafting or reviewing employment contracts, training agreements, non-compete agreements and confidentiality agreements as well as other HR agreements and documents;

  • Drafting or reviewing collective contracts and attending the collective bargaining;

  • Drafting or reviewing employee handbooks, and other company internal rules and policies;

  • Providing training on special issues and hot issues in connection with the legislation and legal practice of labor and employment law;

  • Advising on issues in connection with labor protection, work-related injuries and occupational diseases;

  • Assisting expatriates in obtaining Work Permits and dealing with other employment formalities;

  • Advising on issues in connection with social insurance, commercial insurance and benefit plans.

  • Attending negotiations, developing the plans for layoffs or employee transfer in the process of corporate merger, reconstruction or liquidation and drafting or reviewing the necessary transaction documents;

  • Assisting in conducting internal compliance investigations and advising on how to deal with those employees who violated compliance policies.  

Recent Representative Cases

  • Represented a multinational company before labor arbitration tribunals and courts in four cities in over 40 labor dispute cases arising from termination over non-compliance issues in 2015.  Nearly 10 lawyers were involved in these cases to collect a large volume of evidence and attend numerous hearings before labor arbitration tribunals and labor courts in four cities.  Achieved positive results that were  satisfactory to the client.


  • Assisted a multinational IT company in a mass layoff project in 2015 due to the shutdown of its Beijing R&D centre.  Nearly 300 employees were laid off.  Provided counsel, document preparation and on-site support throughout the entire project. 


  • Assisted the client in a mass layoff project in 2015 as a result of the shutdown of its plant in Shanghai.  Over 200 employees were laid off. Provided counsel, document preparation and on-site support throughout the entire project.  Assisted the client in successfully resolving a crisis created by upset employees.


  • Assisted a US hi-tech listed company in a mass layoff project in 2015 as a result of a corporate restructure in multiple cities across the country.  Over 700 employees were laid off.  Provided counsel, document preparation and on-site support throughout the entire project.  Assisted the client in successfully resolving a crisis created by upset employees.
