International Trade

JunHe is among the first group of Chinese law firms to deliver legal services relating to international trade.  Consistently at the forefront of international trade practice, we are credited with many brilliant achievements, not only in representing Chinese enterprises and the government in actions pertaining to outbound antidumping, countervailing duties and safeguards as well as U.S. Section 337 investigations and other international trade disputes, but also in defending foreign enterprises in investigations launched by the PRC on antidumping, countervailing duties and safeguards.

Our Team

JunHe’s international trade team includes more than 20 partners and associates, who graduated from top law schools in the PRC and other jurisdictions.  Our lawyers specialize in international trade law and practice and are proficient in multiple languages, including Chinese, English and Japanese.  We deliver a full range of professional services, tailored to meet our clients’ specific needs.

Based on their outstanding market contributions, legal expertise and depth of experience, our international trade attorneys are recognized each year as leading lawyers in the antidumping practice in China by Asia Pacific Legal 500.

Key Practice Areas

  • Trade remedies.  We represent foreign clients in actions launched by the PRC government on outbound antidumping, countervailing duties and safeguards.  We also defend Chinese clients in investigations initiated by foreign governments on antidumping, countervailing duties and safeguards.

  • World Trade Organization (WTO) legal advice and dispute resolution.  We represent the Chinese government in the WTO dispute settlement process and advise Chinese and foreign clients on issues relating to the WTO dispute settlement and trade policy compliance.

  • U.S. Section 337 Investigations.  We represent both Chinese and foreign clients in their defense of U.S. Section 337 investigations. We also provide strategic advice on intellectual property and dispute prevention.

  • Customs.  We counsel clients on customs matters and provide legal advice and on-site guidance during customs audits.  We represent both Chinese and foreign clients in negotiations with the General Administration of Customs, the General Administration of Quality Supervision, Inspection and Quarantine, and their local counterparts in the PRC.  We also represent Chinese clients and communicate with foreign customs authorities in connection with customs matters outside of China.

  • Other related practices.  We act for clients in the preparation and review of contracts for international sale of goods and advise on marine cargo and related insurance issues.

A Nationwide Leader in Trade Remedies

Our international trade group includes some of the first domestic lawyers to engage in the antidumping and countervailing duty practice in China.  In the past decade, we have defended both Chinese and foreign companies in hundreds of antidumping and countervailing duty investigations initiated by major jurisdictions, such as the U.S., EU, China and Canada.  We prevailed in the great majority of cases, obtaining zero or reduced sanctions and/or dismissals of the cases.

A Pioneer in U.S. Section 337 Investigations

Our international trade group has handled many of the U.S. Section 337 investigations in China, and is a pioneer in the development of such practice area in the Chinese market.  When determining a Section 337 case in 2006, the United States International Trade Commission held that JunHe’s lawyers, admitted to practice law in the PRC and New York, could have access to any and all trade secrets, including those of the claimant.  This ruling guaranteed JunHe’s right to deliver substantial advice in connection with the Section 337 investigation and became the precedent for representation by qualified PRC lawyers and other non-American lawyers in future investigations.  In 2012, the United States International Trade Commission held that JunHe’s lawyers could simultaneously act for clients in the U.S. Section 337 investigation and related litigation commenced within China.  Such determination expanded the role of Chinese lawyers in China and the U.S. in Section 337 investigations.

A Practitioner of International Cooperation and Government Communications

Over the years, we have fostered strong ties with top-tier international trade law firms as well as close communications with China’s Ministry of Commerce, General Administration of Customs, and chambers and societies of commerce for import and export.  Through such cooperation and communication, our international trade team has real-time access to the latest updates and judicial practices in the PRC as well as to foreign laws and policies.  Our team leverages the latest international trade rules and most effective remedies to protect the best interests of our clients and to prevent or mitigate fines arising out of the misuse or abuse of international trade rules by law enforcement agencies.
