Construction refers to the construction of various types of buildings and ancillary facilities as well as the installation of related lines, pipes and equipment. Corporate clients require legal services in connection with their construction, alteration, expansion, fit-out and relocation projects.

JunHe provides clients in construction projects with the following services:


  • Providing legal advice. Provide legal advice and recommendations for the acquisition of land plots and obtaining governmental approvals in connection with construction projects, and assist clients in determining the contracting structure of their construction projects;

  • Document drafting and reviewing. Draft, review and revise agreements and other documents, including the agreements and tendering documents relating to survey, design, procurement, construction, project supervision, project management, and construction cost consulting service, and participate in negotiations;

  • Risk control. Assist clients with legal issues arising in the course of implementing their construction projects; and

  • Dispute resolution. Assist clients in resolving their disputes and represent clients in arbitration and litigation proceedings. 


Recent Representative Cases

Construction of a New Energy Vehicle Manufacturing Plant


From 2021 – 2023, a well-known automobile company built a new energy vehicle manufacturing plant.  This involved a total investment of around RMB 30 billion (including an investment of more than RMB 4 billion in the related construction project) and was built on a land plot of about 1.5 million square meters. JunHe advised the client (as the project owner) from the project initiation stage and assisted the client in signing an investment agreement with the local government.  JunHe assisted the client in obtaining the related land use rights, designed and determined the contracting structure, reviewed the tendering documents, and drafted, revised and finalized the EPC contract. JunHe also assisted in drafting the project supervision contract, the project management contract and other relevant contract documents and provided legal advice at the construction stage. 


Chi Fu Headquarters’ Building Construction Project 


JunHe advised Chi Fu Investment (China) Inc. Ltd. in its acquisition of a land parcel located at the Expo Area in Pudong New Area, Shanghai and provided the client with legal services throughout the construction of the Chi Fu Headquarters’ Building. JunHe assisted the client in determining the contracting structure,  drafted and reviewed all the agreements and other relevant documents relating to the construction project and assisted the client in dealing with the issues and potential disputes arising in the implementation of the project.


Nike China Logistics Center Project


JunHe advised Nike Sports (China) Co., Ltd. on the expansion and alteration of its China Logistics Center in Taicang, Jiangsu Province. JunHe assisted the client in determining the contracting structure, evaluated the feasibility of adopting new technology, processes and materials for the project, and provided legal advice in its application for the necessary governmental approvals. JunHe also drafted and reviewed the tendering documents, agreements and the other relevant documents, and dealt with issues arising during the implementation of the project. 


The Asia Flagship Store of a Well-known Consumer Electronics Brand


JunHe advised a well-known consumer electronics brand on the development of its largest flagship store in Asia located in Shanghai. It took several years from the proposed establishment to the opening of the store, during which time significant laws, regulations and mandatory engineering specifications were promulgated and adjusted, including those governing the right to use the land for underground construction, fire protection and outdoor signboards. JunHe reviewed the lease agreement, provided compliance advice on the application for various licenses and permits needed for the store fit-out and store signboard, assisted the client in communicating with the lessor and the relevant governmental authorities, and provided advice on the legal issues during the performance of the lease agreement. 


Zhengdong New Area Longhu Financial Center Project in Zhengzhou


JunHe advised CCCC (Zhengzhou) Investment Development Co., Ltd. on its Zhengdong New Area Longhu Financial Center Project. JunHe reviewed and revised various tendering documents and the agreement with the general contractor, as well as the pile foundation, curtain wall, HVAC, fire protection, elevator and other construction and equipment procurement and installation contracts, and assisted the client in dealing with various issues arising during the implementation of the project. 


Xinjiang Kanas Amusement Park Project


JunHe assisted Burjin Kanas Cultural and Tourism Management Co., Ltd. with the development and construction of its Xinjiang Kanas Amusement Park Project, which has a film and television theme. JunHe reviewed and revised the various tendering documents, contracts and agreements regarding general contracting, design consultation, landscape design,, environmental impact assessment,  construction cost consulting service, project supervision, project management, tendering agency, as well as the fit-out and warranty. JunHe also assisted the client with various issues arising during the implementation of the project.
