On the 16th and 18th of November, 2018, Ms. Christine KANG, partner of JunHe, was invited to speak at the World Intellectual Property Organization (“WIPO”) Mediation and Arbitration Workshop. The workshop was hosted by WIPO Arbitration and Mediation Center in Shenzhen and Shanghai. It was co-hosted by the Intellectual Property Office of Shenzhen Municipality and the Shenzhen Court of International Arbitration, the Shanghai Intellectual Property Administration, the Shanghai Commercial Mediation Center, and the Shanghai International Economic and Trade Arbitration Commission, respectively.
The aim of the workshop was to share the complex rules and practices involved in alternative dispute resolution (ADR) in IP cases, from both an international and domestic perspective. During the workshop, Mr. Ignacio De Castro, deputy director of WIPO Arbitration and Mediation Center, introduced the WIPO Arbitration and Mediation rules, and attorneys from Germany and Singapore also spoke on international arbitration and mediation practice in IP disputes. Our Partner Christine KANG delivered an excellent speech on two topics, ‘intellectual property arbitration’ and ‘WIPO arbitration awards’, based on her abundant experience in international arbitration. She expanded on the legal framework of international arbitration, arbitration procedural aspects, the special features of international IP disputes, and compared arbitration in litigation in IP disputes. Ms. Kang also shared her opinions on practical matters, such as drafting awards, scrutiny of awards, allocation of arbitration costs, and the challenge and enforcement of arbitration awards. There were more than 300 people, including in-house counsels from different enterprises, in attendance. Her professional and engaging speech was highly praised by officials from WIPO, IP administrators from Shanghai and Shenzhen and other participants.
